CB-Jammu gets anticipatory bail applications of accused dismissed; Hon’ble Court allows warrant of arrest U/S 512.
Jammu, January 23, 2021: Crime Branch Jammu strongly contested Anticipatory bail application of accused- Manjeet Singh S/O S. Manjeet Singh R/O EQ 54 Pacca Bagh Jalandhar Punjab and got the bail dismissed after convincing the Hon’ble Court of 3rd Addl. Sessions Judge Jammu on merits of the case in case FIR No. 21/2003 U/S 420, 467, 468, 471/RPC P/S Crime Branch Jammu for his involvement in managing a fake PRC for claiming the residential status of J&K.
The instant Case was registered in Crime Branch Jammu in the year 2003 for his involvement in manipulating a fake PRC (Permeant Resident Certificate) as resident of J&K in his favour. The charges against the accused were proved and subsequently charge-sheet was produced in the Hon’ble Court of CJM Jammu in Sept. 2006. However, during the trial of the case, presence of the accused was sought by the Hon’ble Court but the accused did not appear before the Hon’ble Court which led to adjournment of the Court. The accused kept on evading his presence before the Hon’ble Court. Consequently proceeding U/S 512 Cr.PC were initiated against the accused for effecting his arrest. The accused remained at large and kept constantly evading his arrest by changing his locations frequently. However, Crime Branch Jammu kept on constantly chasing and raiding his hideouts.
Sensing his arrest, the accused moved application for his anticipatory bail before the Hon’ble Court of 3rd Addl. Sessions Judge, Jammu. On this CB-Jammu vigorously contested against his bail application in the Hon’ble Court of law and after putting arguments on merits of the case before the Hon’ble Court, the Hon’ble Court observed that the provision of anticipatory bail under section 497-C J&K Cr.PC is meant for those innocent persons who have been wrongly roped in a false and frivolous case and protection of law is required to be provided to them. The provision is not meant for the persons who have no respect of law and they have themselves chosen to remain away from the clutches of law for their own facilitation. For this reason the bail application was dismissed and the same was consigned to records after its due compilation. The general warrant for arrest U/S 512 Cr.PC issued by the Hon’ble Court shall remain effective till its execution.
